Detransitioner Wins $2 Million in Malpractice Lawsuit

A New York court has reached a landmark decision—the first of its kind in the United States—after a “detransitioner” named Fox Varian sued her psychologist and surgeon for medical malpractice regarding a double mastectomy she was given at age 16. The court sided with Varian, holding the doctors accountable for pressuring her into an irreversible surgery at such a young age.

According to reports,

Psychologist Kenneth Einhorn and surgeon Simon Chin were held responsible . . . for ignoring standards of care and procedural guardrails by pressuring the minor into addressing gender dysphoria with permanent surgery, the jury decided.

Lawyers for Varian pointed the finger at Einhorn, saying he “drove the train” and was “putting the idea in Fox’s head” that she needed to change her gender with surgery.

And this doctor didn’t just pressure the 16-year-old, but also her mother (a story we hear over and over again!), telling her that her daughter would commit suicide if she didn’t consent to the procedure. Reportedly her mother shared,

This man was just so emphatic, and pushing and pushing, that I felt like there was no good decision. . . . I think it was a scare tactic. I don’t believe it was malice, I think he believed what he was saying — but he was very, very wrong.

This is what so many parents of children who struggle with their gender identity are told—that they must allow their child to take puberty blockers and cross-sex hormones and even have surgery or they will lose their child. Rarely are parents or their children told of the physical risks of these procedures or the fact that studies show these measures don’t actually make things better!

Changing one’s body doesn’t change the biological reality that humans are either male or female.

The failure of the trans movement to help young people is not a surprise to those with a biblical worldview. A boy can’t be a girl, and a girl can’t be a boy. Changing one’s body doesn’t change the biological reality that humans are either male or female, nor does living in defiance of God’s created order of male and female bring lasting peace or joy. One cannot change one’s genetics!

It’s good to see doctors who have been involved with what really amounts to medical experimentation on children held accountable for their actions. As more such cases make their way through the courts (and there will be many more to come), I trust more doctors and hospitals will likewise be held accountable for their part in irreversibly damaging thousands of children and young people.

The answer to identity issues isn’t body-mutilating surgeries—it’s God’s Word and the gospel of Jesus Christ and an identity grounded in him, what he did for us, and how he created us.
